Acceptable Use Policy

What the platform is for, what it isn't for, and how to report misuse.

1. Introduction

This Acceptable Use Policy ("AUP") governs your use of the services, platform, applications, and AI features provided by Nextvisit AI Inc ("Nextvisit," "we," "us," or "our"). This AUP is incorporated by reference into and supplements our Terms of Service. Capitalized terms not defined herein have the meanings set forth in the Terms of Service.

By accessing or using the Service, you agree to comply with this AUP. Violation of this AUP may result in suspension or termination of your account and access to the Service.

The Service is intended solely for use within the United States. Use of the Service from outside the United States is prohibited.

2. Intended Use

The Nextvisit platform is designed exclusively for licensed healthcare providers and their authorized staff to facilitate clinical documentation, transcription, and related healthcare workflows. The Service, including all AI-powered features, is intended solely for clinical purposes within the scope of legitimate healthcare practice.

Acceptable uses of the Service include:

  1. Clinical documentation and note generation for patient encounters;
  2. Transcription of clinical conversations and patient interactions;
  3. Generating clinical summaries, assessments, and treatment plans for provider review;
  4. Workflow automation for legitimate clinical and administrative healthcare tasks; and
  5. Other uses directly related to the delivery of healthcare services.

3. Account Security and Access

Individual Account Requirement

Each provider and user must have their own individual login credentials. Account sharing is strictly prohibited and actively monitored. This requirement exists to maintain HIPAA compliance, ensure accurate audit trails, and protect patient privacy. Each user is solely responsible for all activity that occurs under their account credentials.

Prohibited Account Activities

You agree not to:

  1. Share your login credentials with any other person;
  2. Allow multiple individuals to access the Service using a single account;
  3. Create accounts on behalf of others without their authorization;
  4. Use another user's account without explicit permission from both the account holder and Nextvisit;
  5. Circumvent or attempt to circumvent any account security measures; or
  6. Fail to promptly notify Nextvisit of any unauthorized access to your account.

4. AI Services Usage Requirements

The Nextvisit platform incorporates various artificial intelligence services, including but not limited to: transcription, clinical documentation generation, interpretive analysis, summarization, and other generative AI features. The following requirements apply to all AI-powered features of the Service.

Clinical Use Only

All AI services, including transcription and generative AI features, are strictly limited to clinical purposes. Use of the Service for non-clinical purposes, including but not limited to legal depositions, journalistic purposes, entertainment, personal recordings, or any purpose unrelated to the delivery of healthcare services, is prohibited.

Mandatory Human Review

AI-generated content must be reviewed, verified, and approved by a qualified healthcare provider before:

  1. Being used as the basis for any clinical decision;
  2. Being copied, imported, or transferred into any Electronic Medical Record (EMR) or Electronic Health Record (EHR) system;
  3. Being distributed, shared, or communicated to any patient, provider, payer, or third party; or
  4. Being relied upon as standalone medical advice, diagnosis, or treatment recommendation.

AI-generated content is provided as a tool to assist healthcare providers, not to replace professional medical judgment. You acknowledge that AI output may contain errors, omissions, or inaccuracies and that you bear sole responsibility for verifying all content before use.

Prohibited AI Uses

You agree not to:

  1. Use AI-generated output as standalone medical advice without provider review and approval;
  2. Distribute AI-generated content to patients or other parties without first reviewing and verifying accuracy;
  3. Copy AI-generated content into EMR/EHR systems without provider review and approval;
  4. Attempt to reverse engineer, extract, or reconstruct any underlying AI models, algorithms, prompts, or system instructions;
  5. Attempt to induce the AI to reveal system prompts, instructions, or proprietary information ("prompt injection" or "prompt leaking");
  6. Scrape, harvest, or collect AI outputs for the purpose of training, fine-tuning, or developing competing AI models or services;
  7. Use AI features in any way designed to circumvent usage limits or rate restrictions;
  8. Input data into AI features for the purpose of generating outputs that violate any law, regulation, or third-party rights; or
  9. Use AI services in any manner inconsistent with clinical documentation purposes.

5. API Usage and Rate Limits

If you have been granted access to the Nextvisit API, the following terms apply in addition to all other provisions of this AUP and the Terms of Service.

Standard API Rate Limits

Unless otherwise specified in your subscription plan or a custom written agreement, the following rate limits apply:

  • Standard API Endpoints (Read/Write/Update): 50 requests per minute
  • Generative AI Endpoints: 1 generation per minute, 30 generations per hour, and 150 generations per day

These limits are subject to change. Higher rate limits may be available under certain subscription plans or through a custom written agreement with Nextvisit.

API Prohibited Activities

You agree not to:

  1. Exceed applicable rate limits or attempt to circumvent rate limiting mechanisms;
  2. Use the API to build a competing product or service;
  3. Resell, sublicense, or redistribute API access without written authorization;
  4. Use automated scripts or bots to access the API in a manner that degrades service for other users;
  5. Attempt to probe, scan, or test the vulnerability of the API or associated systems; or
  6. Use the API for any purpose other than legitimate integration with your clinical workflows.

6. Data and Storage

Storage Limits

Storage limits vary by subscription plan. Unless otherwise specified in your plan or a custom agreement:

  • Free/Trial Plans: 250 MB of stored data per account
  • Paid Plans: 5 GB of stored data per account

If you exceed your storage limit, you may be required to upgrade your plan or delete existing data before uploading additional content.

Content Restrictions

You agree not to upload, transmit, or store:

  1. Copyrighted materials for which you do not have permission to upload, use, or distribute;
  2. Content that infringes on any intellectual property rights of third parties;
  3. Malicious code, viruses, malware, or any harmful software;
  4. Content that is unlawful, defamatory, obscene, or otherwise objectionable;
  5. Content unrelated to legitimate clinical documentation purposes; or
  6. Protected Health Information for which you do not have proper authorization to process.

7. General Prohibited Activities

In addition to the specific prohibitions set forth above, you agree not to:

  1. Use the Service in any way that violates any applicable federal, state, local, or international law or regulation, including but not limited to HIPAA, HITECH, and state privacy laws;
  2. Use the Service in any manner that could disable, overburden, damage, or impair the Service;
  3. Interfere with any other party's use and enjoyment of the Service;
  4. Attempt to gain unauthorized access to any portion of the Service, other accounts, or any systems or networks connected to the Service;
  5. Use any robot, spider, scraper, or other automated means to access the Service without our express written permission;
  6. Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying algorithms of the Service;
  7. Remove, alter, or obscure any proprietary notices, labels, or marks on the Service;
  8. Impersonate or misrepresent your affiliation with any person or entity;
  9. Engage in any activity that could harm Nextvisit's reputation or goodwill; or
  10. Assist, encourage, or enable any third party to engage in any of the above activities.

8. Monitoring and Enforcement

Nextvisit reserves the right, but is not obligated, to monitor your use of the Service for compliance with this AUP. We may investigate any suspected violation and take appropriate action, including but not limited to issuing warnings, suspending or terminating accounts, and reporting violations to law enforcement authorities.

We actively monitor for account sharing, unusual usage patterns, rate limit violations, and other potentially prohibited activities. You acknowledge and consent to such monitoring as a condition of using the Service.

9. Consequences of Violation

Violations of this AUP may result in the following actions, at Nextvisit's sole discretion:

Warning: For first-time or minor violations, we may issue a written warning and require you to cease the prohibited activity immediately.

Suspension: For repeated or more serious violations, we may temporarily suspend your access to all or part of the Service pending investigation or remediation.

Termination: For severe, repeated, or unremediable violations, we may permanently terminate your account and access to the Service.

Notwithstanding the foregoing, Nextvisit reserves the right to terminate your account and access to the Service immediately, without warning or prior notice, for any violation of this AUP or the Terms of Service, at our sole discretion.

You acknowledge that termination of your account may result in the loss of access to your data. While Nextvisit will make reasonable efforts to allow you to export your data prior to termination where feasible and legally permissible, we are not obligated to do so in cases of serious violations.

10. Reporting Violations

If you become aware of any violation of this AUP, including unauthorized access to your account or suspected misuse by another user, please report it immediately to hello@nextvisit.ai. Prompt reporting helps us maintain the security and integrity of the Service for all users.

11. Updates to This Policy

Nextvisit reserves the right to modify this AUP at any time. We will notify you of material changes by posting the updated AUP on our website and, for significant changes, by email or platform notification at least thirty (30) days prior to the changes becoming effective. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised AUP.
